The Eagles sue Hotel California

The Eagles have filed a lawsuit accusing the owners of a Mexico hotel of using the name "Hotel California," arguably the band's most famous song, without permission.

In a complaint filed late Monday, the Eagles said owners of the 11-room Todos Santos hotel in Baja California Sur "actively encourage" guests to believe the hotel is associated with the band, in order to sell t-shirts and other merchandise, and make guests feel welcome.

This allegedly included piping "Hotel California" and other Eagles songs through the hotel sound system, and selling t-shirts in that refer to the hotel as "legendary," resulting in apparent confusion among many guests who posted online reviews.

The Eagles also noted that the defendant Hotel California Baja LLC has applied with the US Patent and Trademark Office to register the Hotel California name.

"Defendants lead US consumers to believe that the Todos Santos Hotel is associated with the Eagles and, among other things, served as the inspiration for the lyrics in 'Hotel California,' which is false," the complaint said.

The lawsuit filed in Los Angeles federal court seeks a variety of damages and a halt to any infringement.

Neither the hotel nor the lawyer who filed its trademark application immediately responded on Tuesday to requests for comment.

The Todos Santos hotel was named Hotel California when it opened in 1950, but went through a series of name changes before a Canadian couple, John and Debbie Stewart, bought it in 2001, and according to the Eagles began using the original name in marketing.

"Hotel California" is the title track from the 1976 Eagles album of the same name, and won the 1977 Grammy award for record of the year.

It is known for its long guitar outro featuring Don Felder and Joe Walsh, and complex lyrics sung by Don Henley.

In an interview with CBS News last year, Henley said the song is about "a journey from innocence to experience. It's not really about California; it's about America."

The case is Eagles Ltd v Hotel California Baja LLC et al, US District Court, Central District of California, No. 17-03276.

On display at Sanat, her current imagery rising up from the ashes of wood with paint made out of dry pigments minerals and stones challenges the conventional boundaries of miniature in terms of material and its large scale size explains the Lahore-based artist with a BFA degree in Miniature painting and MA honours in Visual Arts. Also a recipient of numerous awards, Qazi delving deeper into her thought and creative process reveals material such as wood ash has never been used on the wasli before.

With multiple layers, erased, re-structured, re-constructed and re-invented to create the image, Qazi reluctant to assert her conclusion or definitive meaning to the series titles her current body of work 'Ek Raaz'. Tucked away safely like a secret that is valuable and precious, Qazi wishes the interpretation to be an open-ended process. The artist, refusing to define as to what it really is, wants the viewers to determine and discover the true meaning hidden in the works as they choose to see it.

Featuring 11 artworks of contemporary miniature, it is Sana Qazi's third solo show since 2014 who lives and works out of Lahore. Titled "Ek Raaz (A Secret)"  the exhibition is to continue till May 4th at Sanat Gallery.

 

Jimmy Kimmel gets emotional describing his newborn’s heart condition

An emotional Jimmy Kimmel on Monday dedicated his monologue to talk about how his son was born with a serious heart issue last month and the importance of health coverage and the Affordable Care Act, introduced by the Obama administration.

"It was a scary story and, before I go into it, I want you to know it has a happy ending," he said during his show Jimmy Kimmel Live.

The comedian and actor described how their baby William John nicknamed Billy had a normal birth and his family was in recovery at the Cedars-Sinai Hospital in Los Angeles. He was then told by doctors that the baby's heart's pulmonary valve was completely blocked and there was a hole in the wall between the left and right sides of his heart.

"It's a terrifying thing," Kimmel said, his voice breaking. "You know, my wife is back in the recovery room, she has no idea what's going on and I'm standing in the middle of a lot of worried looking people -- kind of like right now -- who were trying to figure out what the problem is."

Kimmel also slammed Donald Trump's proposed cuts to the National Institutes of Health and appreciated Congress opting for increased funding instead.

"If your baby is going to die and it doesn't have to, it shouldn't matter how much money you make … Whether you're a Republican or a Democrat or something else, we all agree on that, right?" he said.

Kajol deletes viral video of eating beef, clarifies 'it was buffalo meat'

Eating beef in India can be quite a sensitive issue, because of the religious sentiments attached to the cow.

And it was realized by Bollywood actress Kajol after she posted a video on her Instagram where she was served 'beef pepper water with dry lentils and dry beef' by her friend Ryan Stephen while lunching with friends.

After the video went viral, Kajol apparently got scared of a possible reaction from Hindu extremists so, she decided to clarify that the dish in the video was made from buffalo meat and not beef (cow meat).

Kajol has since deleted the video but the pictures from the lunch are still on her Instagram account.

Kendrick Lamar's 'Damn' holds steady atop Billboard 200 chart

Rapper Kendrick Lamar's latest album "Damn." held onto the top spot of the weekly U.S. Billboard 200 album chart on Monday, holding off Drake and Ed Sheeran.

Lamar's "Damn.," which debuted atop the chart last week, sold a total of 238,000 album units in its second week of release, according to figures from Nielsen SoundScan.

Canadian rapper Drake's "More Life" climbed one spot to No. 2, while British singer Sheeran's "Divide" climbed one spot to No. 3.

The Billboard 200 album chart tallies units from album sales, song sales (10 songs equal one album) and streaming activity (1,500 streams equal one album).

New albums in the top 10 of the Billboard 200 chart this week include rockers Incubus at No. 4 with "8" and the soundtrack to the upcoming Marvel superhero film "Guardians of the Galaxy Vol. 2" at No. 8.

On the Digital Songs chart, which measures online single sales, Puerto Rican singer Luis Fonsi's "Despacito" climbed from No. 8 to No. 1 with 86,000 downloads sold.
